were fired from Kendrick's
parking lot."
Barnstable Police Sgt.John
Francis Murphy, Jr., testified
that, on enteringthe club, he
smelled gunpowder and saw
smoke above the dance floor.
Also, he saw two holes in the
ceilingthat appeared to have
been caused by gunshots. His
search for shell casings was
unsuccessful.
Case not proved, according
to the commission, which
commented that "there is
no lawful basis to hold the
licensee responsible for any
illegal conduct outside the
licensed premises including
the parking lot."
Finally, the ABCC said it
"was not presented with any
information that there was
any entertainment after 12:30
a.m." Bottom line for all
charges? "...the Commission
is not persuaded that there
are violations..."
The town had 30 days from
receipt of the decision to
appeal it in Superior Court.
While the board discussed
Kendrick's at its meeting
Monday, no action was taken
except to grant the business
another continuance of a
show-cause hearing related
to aJuly 14incident,this time
until Dec. 4.
"The ABCC had no author-
ity to overturn this ruling,"
said Tom Geiler,the licensing
board's agent. "They do have
the right to remand. Usually
when there's a decision they
question,they send it back to
the local authority for a new
hearing."
Asked whether the decision
wastantamount to areversal,
an ABCC spokeswoman said
yesterday she would review
the case and call back. A
response was not received
before press time.
In addition to its Dec. 4
date withthelicensingboard,
Geiler said Kendrick's will
be before the ABCC itself
later this year to respond to
a complaint brought by an
agency investigator who said
the business served a minor.
"I don't think the licensing
board is overly concerned
about this one ABCC deci-
sion," he said.
