On or about the August 7, 2006, the Town of Barnstable will submit a request to the
U.S. Department of Housing and Urban Development (HUD) for the release of funds
under Title 1 of the Housing and Community Act of 1974 (PL93-383) for the following
programs and activities.
1. ADA Compliance/Handicapped Access Program
Town of Barnstable, GMD, $25,000 CDBG Funds
ADA Compliance Program: Handicap accessibility
improvements at various public buildings and housing facilities
within the Town of Barnstable
2. Affordable Housing Program
Town of Barnstable, GMD
a) Accessory Affordable Housing Program, $155,000 CDB
Funds: Conversion of illegal apartments and creation of new hous-
ing units in existing residential structures through a Comprehensive
Permit process.
b) Affordable Housing Program , $310,000 CDBG Funds:
Acquisition and/or rehab of affordable housing units.
The activities proposed are categorically excluded under HUD regulations at 24 CFR
Part 58 from National Environmental Policy Act (NEPA) requirements. An Environmental
Review Record (ERR) that documents the environmental determinations for these
projects is on file at the Town of Barnstable's Growth Management Department, 367

Floor, Hyannis, MA 02601 where the ERR can be examined and copied
Monday through Friday from 8:30am to 4:30pm.
PUBLIC COMMENTS
Any individual, community group, or agency may submit written comments on the ERR
to the Town of Barnstable, Growth Management Department, 367 Main Street, Z" Floor,
Hyannis, MA All comments received by Friday,August 4,2006 will be considered by the
Town of Barnstable prior to authorizing submission of a request for release of funds
RELEASE OF FUNDS
The Town of Barnstable certifies to HUD that John C. Klimm in his capacity as Town
Manager consents to accept the jurisdiction of the Federal Courts if an action is brought
to enforce responsibilities in relation to the environmentalreview process and that these
responsibilities under NEPA have been satisfied HUD's approval of the certification
satisfies its responsibilities under NEPA and related laws and authorities and allows
the Town of Barnstable to use Progra m funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD/State will accept objections to its release of fund and the RE's certification
for a period of fifteendays following the anticipated submission date or its actual
receipt of the request (whichever is later) only if they are on one of the follow-
ing bases: (a) the certification was not executed by the Certifying Officer of the
name of RE; (b) the RE has omitted a step or failed to make a decision or finding
required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other
participants in the development process have committed funds, incurred costs
or undertaken activities not authorized by 24 CFR Part 58 before approval of a
release of funds by HUD/State; or (d) another Federal agency acting pursuant to
40 CFR Part 1504 has submitted a written finding that the project is unsatisfac-
tory from the standpoint of environmental quality. Objections must be prepared
and submitted in accordance with the required procedures (24 CFR Part 58, Sec.
58.76) and shall be addressed to HUD/State administration office af address of that
office. Potential objectors should contact HUD/State to verify the actual last day
of the objection period
