TOWN OF BARNSTABLE BUILDING CODE
SECTION 1. ADMINISTRATION AND SUPERVISION
Clause a. The name and title ot this by-law shall be "THE BUILD-
ING CODE" and it shall be known and cited as such.
Clause b. The object and scope of this regulation are the governing
and regulating of the construction and erection , remodeling, «"erMWn,
repairing and moving or buildings of any description in he low ., and
providing tor the safety of all present and future buildings and the
safe use of them, and providing tor all other matters pertaining to
buildings and. building operations in said Town.
Clause c. It shall be unlawful and subject to the penalties herein-
after provided for any porson. persons, linn or corporation to construct ,
erect , repair, alter , add to, move any building or portion thereof , or to
carry on any building operation in the Town, except in compliance
I with the terms and provisions of the Code.
Clause d. inspector of Buildings. The Board of Selectmen annually
, in March , and subsequent to the Annual Town Meeting, shall appoint
an inspector of Buildings to hold office for the term of one year from
the first day ot April following and until his successor Is appointed and
qualified.
Clause e. The person appointed and qualified to act as inspector
ot Buildings shall receive such salary or compensation as shall be fixed
within the appropriation for the Inspector of Buildings. He shall have
no pecuniary Interest direct or indirect In the making of plans or speci-
fications or lu the supplying of materials or labor for any building In
this Town, other than its own.
Clause t He shall be under the supervision "of the Board of Select-
men, and he shall be subject to such rules and regulations as they muy
prescribe for the proper conduct ot his office. He shull submit an annual
report in January of each year of the work ot his office for publication
in the Town Report.
Clause g. Tlie Inspector of Buildings shall make Inspections of
all Building operations within the Town, and he may, for this purpose,
enter upon premises where such operations are carried on, at all rea-
sonable times, and report to the Board of Selectmen all violations of
this by-law and Building Code, or of the conditions of any permit issued.
Clause h. The Building Inspector shall have the authority to stop
the construction ot any building, or the making of any alteration or re-
pairs to any building, within said Town, when the same Is being done
In a reckless, or careless manner, or in violation of this Code, or any
ordinance of the Town.
Clause i. Any person aggrieved by a decision of the Building In-
spector may appeal from such decision to a Board consisting of the
Selectmen and the Town Counsel. Their decision shall be final.
Clause j. The Building Inspector , with the approval of the above
mentioned Board may give authorization for the use of construction
of materials not specified In this building code, providing they are of
equivalent strength and safety.
SECTION II. DEFINITIONS
Clause a. The following terms shall have the following meanings:
1. "Dwelling ". A residence building designed for or used as the
home or residence of not more than two separate and distinct families,
and having Bleeping and sanitary facilities.
2. "Approved". Built according to the rules of the National Board
of Fire Underwriters.
3. "Dead Load." Any load , other than the dead load, and Including
4. "Bearing Partition. " A wall supporting a load other than its
own weight.

6. "Fire Wall. " A wall built or adapted to prevent or limit tfie
spread of fire.
7. "Partition Wall." An Interior wall of a building.
S. "Party Wall. " A wall that separates two or more structures and
is used or adopted for the use of more than one building.
9. "Dimensions." The dimensions of timber as used in this Code
shall have the meaning generally used In the building trades. |
10. "First Class Building." Any building constructed of fireproof
materials throughout.
11. "Second Class Building." Any building constructed with its
exterior walls of fireproof materials.
12. "Third CISBS Building." Any building having Its exterior walls
constructed in whole or in part of combustible materials.
SECTION III. PRELIMINARY REQUIREMENTS AND PERMITS
Clause a. No person shall erect, alter, or substantially repair any
building or structure without having first obtained a permit for the
same.
1. Exception. Nominal repairs may be made without a permit, pro-
vided it does not involve the cutting away of any part of the structure
or the foundation of the building, or in any way increase the fire risk.
2. Exception. Buildingi or structures owned by the United States,
or the Commonwealth of Massachusetts, or any of its political sub-
divisions.
3. Exception. Bridges quayi and wharves.
Clause b. No building may be moved unless a permit has been
obtained from the Building Inspector. No building may be moved into
the Town unless Its construction Is made to conform to the Building
Code.
Clause c. The Building Inspector may request such plans, specifi-
cations and structural details as necessary, before issuing a permit.
Clause d. The Building Inspector may request such information
from the applicant as concerns the proposed erection or alteration for
the prevention of tire, and tor the preservation ot life, health, and
morals, and may acquire such charges as he deems necessary.
Clause e. A building permit shall become void if work is not
started within 90 days from the date of Issue. A new permit will there-
afterward hav e to be obtained before work is begun.
Clause f. All building permits are subject to the approval of the
Board of Health.
Clause g. No residential building shall be built that does not con-
form to the definition of a "Dwelling " as set forth under Section II.
SECTION IV. RESTRICTIONS AND BUILDING LINES
Clause a. No person shall erect any new building or alteration to
an existing building nearer than five feet to the lot lines of hla land ,
nor nearer than ten feet to any other building on the same lot.
Exception. A new commercial building or an addition to an exist-
ing commercial building may be built nearer to the lot lines ot the
land, if such structure or addition is of fireproof construction, and with
no openings.
Clause b. No person shall erect any new building or an addition
to an existing building nearer than fifteen teet to a public way or place
dedicated to public' use.
Exception. A new building or an addition to an existing building
may be built nearer than fifteen feet to a public way or place dedicated
to public use provided approval ie given by the planning board and the
Board of Selectmen, and a survey is made showing the exact location
of the lines of the public way or place dedicated to public use.
SECTION V. GENERAL PROVISIONS APPLICABLE TO
. ALL BUILDINGS.
Clause a. All buildings hereafter erected shall be built with sills,
posti, glrti, and plates properly braced and framed so as to develop
the maximum strength and rigidity consistent with the purposei foi
which they are to be uied,
Clause o. All materials used shall be of sufficient strength and
lize to safely carry the loads to which they may be subjected without
exceeding the allowable working strength.
Clause c. Not approved.
Clauae d. Rain water leaders shall not be placed to discharge water
upon a sidewalk , and no part of a building may be constructed io aa to
diicharge water , snow, ice, or waste material upon a public way, or a
place dedicated to public use. ¦ •<
Clause e. No building may be erected or any existing building

Clause f. Excavations.
1. All excavations ihall extend to eolid ground.
2. All excavations shall extend below the frost line.
3. All excavations close to adjacent buildingi must be properly

Clauie g, Footings.
1. All footings must be of poured concrete.
2. Minimum footingi ihall be ai followi:
1. Under foundation! of one etory buildingi, iix lnchei thick,
and a three Inch projection on either ilde of wall. ,
2 Under foundation! ot one and a halt and not more than two ,
atory buildingi, eight Inches thick, and a four inch pro-
. jectlon on either aide of the wall.
». Under a twelve Inch wall, the footing must project at least
six Inches on either side of the wall, and be at leait eight
inches thick.
4. Under all lally column! or poits, the footingi must be at
least twenty Inches by twenty Inches and eight Inches
thick.
5. Under chimneys, the footings must project at leait iix
inches on all aldea and be at leait eight lnchei thick.
6. All footings shall be of such width and thlcknesi to lately
reelst the superimposed load without exceeding at any point
the allowable bearing capacity ot the soil.
Clause h. Foundations.
Minimum Acquirements shall be as follows:
1. Six inch thickness for poured concrete supporting one story
wood frame structure without basement.
2. Eight Inch thlckneiB for all other poured walli,
3. Eight Inch thickness for all masonry unit walli which extend
more than eight feet below flniihed grade. Maximum total
height of foundation wall and wall mpported to be not more
than thirty feet to eaves and thirty-five feet to ridge.
4. Twelve Inch thickness for all masonry unit walls that extend
more than eight feet below outside finished grade.
6. All foundations shall be of such width and thickness as to
safely resist the superimposed load without exceeding the
allowable working strength. ¦
Clause I. Piers for girders,
1. Girders must rest on solid masonry.
2. On block foundations, cells ot blocki below girder must be filled
to form solid bearing, or,
3. Pilastere not less than four inches by eigh t inches shull be
built to receive girder ends, or columns may be used.
Clause j. Foundation wall vents shall be installed to ventilate all
II ii excavated spaces.
Clause k. All chimneys shall be lined with flue lining of an ap-
proved type.
Clause 1. No wood shall be closer than one inch, to tbe chimney.
Clause m. The distance between supports under wood girders shall
not exceed the following for a one story building :
1. 4 x 6 6' 4 x 10 8'
6 x 6 6' 6 x 8 8'
4 x 8 6' 4" ¦ 6 x 10 9'
2. For one and a half two-story buildings, deduct one foot from
the above distances.
Clause n. Wood floor Joists.
1. Where Joists frame into side of wood girders, metal hangers or
a bearing strip, spiked to the girder must be used.
2. Floor joists framed into masonry walls shall have at least a
four inch hearing and a three inch fire or bevel cut,
3. Floor joists shall be doubled under all partitions running paralell
to the floor Joists.
4. All headers over four feet long ihall be doubled.
5. Floor joists ihall be cron bridged at leait one by three inch
or stronger stock shall be used.
li. Maximum spam for all floor joists shall not exceed those given
in the following tables, ae set forth by the "Architectural
Graphic Standards."
7: Second floor joists shall be framed the same ae first floor.
8. - When attic space above ceiling joists is unfinished but Is
usable for storage space, or it the space li lultable for
future habitable room or roomi, than ipani will be the lame
as first floor joists.
Clause o. Maximum spans for all celling joists shall not exceed
the following:
1. 2 x 4 8'
2 x 6 13'
2 x 8 16'
2. Celling joists, if possible, should serve as collar ties,
3. Collar ties shall not be placed in excesi of 6' on centers.
Clause p. Wood rafters.
1. The maximum spans lor all wood rafters shall not exceed those
given in the following table, as set forth by the "Architectural
Graphic Standards."

2. Truss construction may be used provided it is ot a strength
comparable to the above, and IB approved by the Building In-
spector.
3. RafterB on roofs with a slope Ieai than five inches to twelve
inches shall be figured the same as floor joists.
Clause q. Exterior Walli Studi.
1, Studs shall not be less than two inches by four inches placed
not more than alxteen lnchei on centers,
2. Headers over all openings shall be doubled and shall not exceed
the following:
1. up to 4' 2—2 x 4'B

7' 2—2 x 8's on edge
over 7' 2—2 x 10's on edge
8, In lieu of headers, approved trussei may be used.
4. StudB in exterior frame wall may run from sill to roof line pro-
vided they do not exceed twenty feet In length.
5. Studs shall not be spliced.
B. Floor joist on exterior walls shall bear on at least a one inch
| by six inch ribbon let Into the face of the itudding. Joists bear-
| ing on such rlbbona ahall be securely nailed to the studs.
7. WherB atuds exceed twenty teet in length, a four Inch by six
inch girt shall be installed continuous at second floor level.
Clause r. Plates.
1. All top plates shall not be not less than two Inches by four
inches doubled, which ahall lap at all corners.
Clause s. Interior Partitions.
1. All bearing partition studs shall not be less than two Inches by
four Inches set the four Inch way, and not more than sixteen
inches on centers.
2. Non-bearing partition studs may be two inches by three inches
set the three inch way and not more than sixteen inches on
centers.
3. All openings In bearing partitions shall have double headers
framed as required In exterior opening!.
4. Top plates tor bearing partition! shall be doubled.

2lBt in the Children's Medical Cen-
ter, Boston, at the age of 22 days.
A private burial service was held
Saturday, Jul y 23, at the Lothrou
Hill Cemetery, Barnstable.
Besides her parents, Cathleen is
survived by four grandparents, Mr.
and Mrs. Walter Royal Jones, Jr.,
of Sparta, New Jersey, and Mr. and
Mrs . Henry M. Lyons ot Louisville ,
Kentucky.

Beal, and Ames Home, Hyannis,
for Alonzo R. BealeB, who died
suddenly on Sunday of a heart
attack at the home of a friend ,
Moses Grace, on Pitcher's Way,
Hyannis.
Mr. Beales, a carpenter, was
born In West Hyannlsport. He was
the son of William T. and Luella
(Chtlds) Bealee,
Surviving are his widow, Harriet
Hamblln Beales, and three daugh-
ters, Mrs. Earle F. Baker of Bass
River, Mrs. Henry M. Meyer of
West Hyannlsport , and Mrs. Irving
Sears of Dennis, also several grand-
children.
Mr. Beales at the time of his
death was 59 years of age. He was
a resident of Hyannis.

Clauie v. No portion of a dwelling or other structure ahall be uied
as a Garage unless the Portion io used shall be separated from the rest
of the building by an incombustible wall and an incombustible celling
in a manner satisfactory to the Building Inspector, unless said Oarage

at least six feet in length.
Clause w. Before the frame of any building is covered with any
interior wall covering the Building Inspector shall be notified, and In-
spection Bhall be made by him before said wall covering is applied.
Clause x. The provisions ot thli section shall not apply to:
1. Buildings or structures owned by the United Statea or tho
Commonwealth of Massachusetts; -
2. Bridges, quays, wharves;
3. Isolated camps.
4. Farm buildings or structurei not In either ease used as dwell-
ings and located more than 100 feet from any other buildings,
it approved by the Building Inspector.
SECTION VI. BUILDING RESTRICTIONS WITHIN CERTAIN
AREAS OF THE TOWN
Building restrictions as set forth in this section shall apply to all
that portion of the town bounded as follows: All the landa or that por-
tion of land lying to the south of and within 160' of Main Street in the
Village ot Hyannis from the Yarmouth Town Line to Fawcett'a Corner ;
and lying to the north of and within 150' of Main Street from Yarmouth
Uoad to Fawcett's Corner.
Clauie a. No wood frame or wooden structures, or additions or
alterations to the same, may be built within the Building Restricted
Area , except as hereinafter provided.
Clause b. A dwelling may be built within the Building Restricted
Area If it has a Are resisting roof.
Clause c. An addition Or alteration may be made to an existing
wooden building if it does not increaee its present ground area by more
than one-third, or in any case by more than six hundred square teet.
Clause d. No commercial building ahall be erected within the Fire
Restricted Area unless its construction conforms to the following
specifications:
1. No part of any exterior wall above ground ahall be erected
within seven feet, six inches of the street location.
Except as hereinafter provided.
2. All exterior walls shall be constructed of brick, stone or con-
crete, not less than twelve inches thick and extending from the
underside of the floor to the roof boarding.
With the approval of the Building Inspector, and the Selectmen,
such walls may be built not less than eight inches thick, pro-
vided the ceiling height shall not exceed ten feet.
3. All bearing partitions shall be constructed of concrete or brick
not less than eight Inches thick, without openings, and extend-
ing from the underside of the floor to the underside of the floor
above, or the roof boarding.
4. Openings In any bearing partition between stores occupied by
the same tenant for tbe same business may be made with the
approval of the Building Inspector, If approved Are-doors are
hung.
5. All non-bearing partitions may be constructed ot wood studding
covered With metal lath and plaster , or other approved Incom-
bustible material.
6. AH ceilings, including ceilings in basements, shall be covered,
with metal lathing and plaster not less than three quarters
of an Inch thick.
7. Division walls In basements shall be constructed of brick or
concrete without openings. Ail partition walls of compartments
ihall he constructed of brick or concrete and all doors must be
of approved flreproot construction.
8. Furnaces and heaters in basements shall be enclosed by walls
set at least four feet therefrom, and constructed of Incom-
bustible materials without openings other than vents and doors
of fireproof materials.
9. Each separate basement tor tenants Bhall have a separate en-
trance.
10. All timber beams or joists, except headers, shall rest at least
tour Inches in outside wall or upon steel girders supported by
metal columns, and all timber floor joists on an eight inch wall
shall rest on top of the wall or be supported by continuous
corbel or by metal stirrups.
11. The ends of all timber floor joists or beams resting on walls
or In walls shall be cut to a bevel of at least three inches.
12. Roofs may be constructed of wood if covered with brick, tile,
slate, tin, copper, or iron, or at least three ply tar and gravel,
or slag or other incombustible materials approved by the build-
ing inspector.
Clause e .All materials used ihall be ot sufficient strength and
size to safely carry the loads to which they may be subjected without
exceeding the allowable working strength.
Clause f. Party walls shall be built not less than twelve Inches
thick ot brick or concrete and such a wall must completely separate
the buildings.
Clause g. No frame building In the Building Restricted Area now
used as a dwelling house, shall hereafter be used as a factory, ware-
house, or garage.
Clause h. Any existing wooden building within the Building Re-
stricted Area damaged by fire or other casualty to the extant of not
more than one-half of its reproduction cost, may be repaired or restore*
to its original condition, if the prevention of fire and the preservation
ot lite are thereby secured. Otherwise it shall be reconstructed bo as
to conform to the provisions ot the Building Code.

Clause 1. Any building, other than a single dwelling, shall have
a convenient and permanent means of access to the roof. Such means
of access shall consist of an opening at least twenty inches by thirty
inches in size.
SECTION VII. PENALTY.
Clause a. Whoever violates any of the provisions ot this ordinance
shall be punished by a fine not exceeding One Hundred Dollars for
each offense.

the vote thereon at the Annual Town Meeting of tbe Town ot Barn-
itable held on March 8, 1949.
