NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
Byvirtue and inexecution ofthe Power ofSalecontained inacertain mortgage
given by Manuel Joseph Brito Jr. to Mortgage Electronic Registration Systems, Inc. as
nominee for Aegis Lending Corporation dated 7/29/2004, registered with Barnstable
County Registry District of the Land Court as noted on Certificate of Title No. 106784,
Document No. 975997 of which mortgage the undersigned is the present holder for
breach of conditions of said mortgage and for the purpose of foreclosing the same
will be sold at PUBLIC AUCTION at 1:00 P.M. on June 7, 2006, on the mortgaged
premises. The entire mortgaged premises, all and singular, the premises as described
in said mortgage:
That certain parcel of land situated in Hyannis, in the County of Barnstable
and Commonwealth of Massachusetts, bounded and described as follows: SOUTH-

WESTERLY by said Lane, forty-one and 79/100 (41.79) feet; NORTHERLY by Lot 88,
one hundred thirty-five and 25/100 (135 25) feet; and EASTERLY by Lot 90, one hun-
dred and 59/100 (100.59) feet. All of said boundaries are determined by the court to be
located as shown on subdivision plan 22825-P (Sheet 2) dated March 20, 1964 drawn
by Nelson Bearse-Richard Law, Surveyors, and filedin Barnstable County Registry of
Deeds in Land Registration Book 125, Page 104 with Certificate of Title No. 17164 and
said land is shown thereon as Lot 89.
Subject to and with the benefit of easements, reservation, restrictions, and
taking of record, if any, insofar as the same are now in force and applicable.
Inthe event of any typographical error set forth herein inthe legal description
of the premises,the description as set forth and contained in the mortgage shall control
by reference.

Togetherwith all the improvements now or hereafter erected on the property
and all easements, rights, appurtenances, rents, royalties, mineral, oil and gas rights
and profits,water rights and stock and all fixtures now or hereafter a part of the property.
All replacements and additions shall also be covered by this sale.
Terms of Sale:
Said premises will be sold subject to any and all unpaid taxes and assess-
ments,tax sales, tax titles and other municipal liens and water or sewer liens and State
or County transfer fees, if any there are, and FIVE THOUSAND DOLLARS ($5,000.00)
in cashier's or certified check will be required to be paid by the purchaser at the time
and place of the sale as a deposit and the balance in cashier's or certified check will
be due in thirty (30) days, at the offices of Doonan, Graves & Longoria, L.L.C., 100
Cummings Center, Suite 213C, Beverly, Massachusetts, time being of the essence
The Mortgagee reserves the right to postpone the sale to a later date by
public proclamation at the time and date appointed for the sale and to further postpone
at any adjourned sale-date by public proclamation at the time and date appointed for
the adjourned sale date.

restrictions, leases, tenancies, and rights of possession, building and zoning laws,

shall have the authority and responsibility for making expenditures from District funds
and shall keep a complete account of all moneys expended by the District and submit
a detailed report of those transactions immediately after the close of the fiscal year,
and incorporate this report into the next annual District report.".
Article 40 To see if the District will vote to amend Article V11. Section 3 of the Bylaws
of the District by deleting the word "prepared" and add in its place the work "prepare"

Commissioners , through their appointed officers, shall be responsible for the care and
maintenance of the fire station property and all fire and rescue apparatus and equip-
ment ' and Section 2 will read as "The Cotuit Fire Department shall be responsible for
fire prevention fire inspection the extinguishing of all fires and the carrying out of all
rescue operations in the District The Board of Fire Commissioners shall be responsible
for the management and control of the fire department they shall appoint the Fire Chief
and other officers as required."
Article 43 To see if the District will vote to amend Article VIII of the Bylaws of the
Distnct by deleting the existing Sections 5. 6 and 7 and re-numbering the existing
Section 8 as Section 5
Article 44 To see if the District will vote to amend Article VIII of the Bylaws of the Distnct
by deleting Section 9
Article 45 To see if the District will vote to amend Article X. Section 2 of the Bylaws
of the District by adding a punctuation mark of comma (.) after the word "voting" and
add the words "provided an article has been included in the warrant for said meeting
fully stating the stipulations of the proposed amendments No action taken at a District
Meeting shall be valid unless the subject matter thereof is contained in the warrant for
such a meeting '
Article 46 To see if the District will vote to amend Article XI . Section 2 of the Bylaws
of the District by deleting "four" and adding the word "five" and adding a sentence at
the end of the Section which reads as follows "Such contracts shall be awarded, and
associated documentation maintained, in a manner consistent with the requirements
of M G L c 30B § et seq "
Article 47 To see if the District will vote to amend Article XI. Section 6 of the Bylaws
of the District by adding a sentence at the end of the Section which reads as follows
"The Committee shall conduct meetings at least once during the fiscal year and ad-
ditionally as required "
Article 4g To see if the District will vote to amend Article XI Section 9 of the Bylaws of
the District by adding after the words "Annual Meeting " words which read as follows:
"Until the first meeting of each fiscal year,the Prudential Committee member shall serve

Article 3: To see if the District will vote to amendArticle V, Section 5 of the Bylaws of the
District to add the words "Clerk of the" immediately prior the first instance of "Prudential
Committee", delete the words "no" and "charge" and add the words "a charge sufficient
to recover the operating costs incurred by the District in providing access to Freedom
Hall" after the words "its amenities at" .
Article 4: To see if the District will vote to amend Article V of the Bylaws of the District
by adding a new Section 8 to the Article with the following wording: "The Prudential
Committee shall have the responsibility of procuring the insurance coverage to meet
the needs of the District and to contract for same"
Article 5: To see if the District will vote to amend Article V of the Bylaws of the District
by adding a new Section 9 to the Article with the following wording: "The Prudential
Committee shall have the sole authority to retain and employ the services of legal
counsel to and for the District and each Department and Board within the District for
any expenditure of $1,000 or more".
Article 6: To see if the District will vote to amend Article V of the Bylaws of the District
by adding a new Section 10 to the Article with the following wording: "The Fire Com-
missioners shall establish a schedule of fees to be charged for providing emergency
medical,ambulance and other services and determine billing and collection procedures
therefore and submit the same to the Prudential Committee for approval".
Article 7: To see if the District will vote to amend Article Vttt , Section 10 of the Bylaws
of the District by re-numbering it as Section 6, deleting the words "two members" and
addingthe words "one (1) member",deleting after the words "Prudential Committee" the
words: "in each event to be appointed by the Chairman of the respective committees."
and deleting the following sentences: "Anyone who is employed by the District, full or
part time, or related to an employee of the District shall be deemed ineligible to serve as
a negotiator for the District in any negotiations with the Union For the purposes of this
paragraph, related to an employee' shall refer to spouse, parents, siblings and children
of firefighters only." and add the sentence "The Fire Commissioners and the Prudential
Committee shall each designate, by majority vote, one of their elected members to be
the negotiating party "
Article 8: To see if the District will vote to raise and appropnate $96,200.00 for the
expenses of the Financial Department
Article 9: To see if the Distnct will vote to raise and appropriate $134,886.00 for the
Barnstable County Retirement Assessment
Article 10: To see if the District will vote to raise and appropnate $60,600.00 for notes
and interest.
Article 11: Tosee if the District will vote to raise and appropriate $28,000.00 to maintain
the street lights of the District
Article 12: To see if the District will vote to raise and appropriate $8,625.00 for the
maintenance of the Cotuit Library.
Article 13: To see if the Distnct will vote to raise and appropriate $309,000.00 for
group insurance.
Article 14: To see if the Distnct will vote to raise and appropriate $25,000.00 for the
maintenance and operation of Freedom Hall
Article 15: To see if the Distnct will vote to raise and appropriate $6,808.00 for the
purpose of reimbursing the Town of Barnstable for services provided by the offices of
the tax collector and assessors to collect the taxes of the Distnct
Article 16: To see if the District will vote to raise and appropnate $1,041,266.00 for
the labor and salanes of the Fire Department; and to raise and appropnate $225,453.00
for the remaining expenses of the Fire Department , to be apportioned approximately
as follows:
Maintenance. $48,600 00
Operating expenses. $175,853 00 and
Miscellaneous. $1.000 00
for a total appropriation of $1,266,719.00
