To the Honorable the Judges ot the Land Court lor the Common- wealth of Massachusetts. Respectfully represents Albert E. Elliott, of Barnstable, (Centerville), in the County of Barnstable and aaid Commonwealth ; that he is owner of a certain lot of land with the buildings thereon, situate in BarnBtable (Centerville), in the County ot Barnstable and said Commonwealth, bounded and de- scribed as follows: A certain piece of land with the buildings thereon, situate in Barn- stable aforesaid, to wit, in the vil- lage of Centervllle, so called, being the same tract which was conveyed to me by Stephen F. Childs, by deed dated March 28, 1898, to which deed reference is made for the lo- cation description and boundaries of the above described parcel. Saving, excepting and reserving from this conveyance, however, a life right for the wife of the aaid Stephen F. Childs as is contained in said deed. Also a certain parcel of land situated in ' aaid Center- ville and being the same conveyed to Alexander K. Crocker by Nathan H. Bearse and another by their deed dated Jan. 18, 1902, to be re- corded in the Barnstable County Registry ot Deeds, to which deed, or the record thereof, reference is hereby m?de for a description of this last named parcel. Also all of the real estate conveyed to the said Alexander K. Crocker by Ed- ward L. White by deed dated Jan. 22, 1902, to which deed reference is made for a more particular de- scription of the premises last above described. For my title, see also the deed of Alexander H. Crocker to me dated November 10, 1902, to be recorded in said Registry of That the record title to said lot of land Is clouded by a mortgage given by Albert E. Elliott , to John E. N. Brown, dated September 18, 1905, and duly recorded Book 273 , Page 506, purporting to secure a note for $600, payable in two years from September 18, 1905 , with in- terest annually, which mortgage ap- pears to be undischarged, unassign- ed and unforeclosed on and by the record. That for more than twenty years after the expiration of the time limited for tho full performance of said condition no payment has been made and no other act done in recognition of said mortgage ; and That the mortgagor named in said mortgage and those claiming under him have been In uninter- rupted posessession of said land tor more than twenty years after the expiration of time limited in said mortgage for the full per- formance of the condition thereof. WHEREFORE your petitioner prays that after appropriate no- tices a decree may be entered on the foregoing allegations as author- ized by Section 15, Chapter 240 ol the General Laws as amended by Chapter 20, of the Acts of 1924.
