To the Honorable the Judges ot the Land Court for the Common- wealth of Massachusetts. Respectfully represents Albert E. Elliott, of Barnstable, (Centerville), in the County ot Barnstable and said Commonwealth; that he is owner of a certain lot of land with the buildings thereon, situate in Barnstable (Centerville), in the County of Barnstable and said Commonwealth, bounded and de- scribed as follows: A certain piece of land with the buildings thereon, situate in Harn- stable aforesaid, to wit, in the vil- lage of Centerville, so called, being the same tract which was conveyed to me by Stephen F. Cbilds, by deed dated March 28, 1898, to which deed reference is made tor the lo- cation description and boundaries of the above described parcel. Saving, excepting and reserving from this conveyance, however, a life right for the wife of the said Stephen F. Childs as is contained ln said deed. Also a certain parcel of land situated in said Center- ville and being the same conveyed to Alexander K. Crocker by1 Nathan H. Bearse and another by their deed dated Jan. 18, 1902, to be re- corded in the Barnstable County Registry of Deeds, to which deed, or the record thereof , reference is hereby made for a description ol this last named parcel. Also all of the real estate conveyed to the Bald Alexander K. Crocker by Ed- ward L. White by deed dated Jan. 22, 1902, to which deed reference is made for a more particular de- scription ot the premises last above described. For my title, see also the deed of Alexander H. Crocker to me dated November 10, 1902, to be recorded in said Registry of Deeds. That the record title to suid lot of land Is clouded by a mortgage given by Albert E. Elliott , to John E. N. Brown, dated September 18, 1905 , and duly recorded Book 273 , Page 500, purporting to secure a note for $600 , payable in two years from September 18, 1905, with in- terest annually, which mortgage ap- pears to be undischarged, unalign- ed und unl'oreclosed on and by the record.
