Toall interested agencies, community groups,andpersons withintheTownof Barnstable.
On or about the May 15, 2005, the Town of Barnstable will submit a request to the
U.S. Department of Housing and Urban Development (HUD) for the release of funds
under Title 1 of the Housing and Community Act of 1974 (PL93-383) for the following
programs and activities.

Town of Barnstable, GMD, EDSI Grant, $48,122
Exterior renovations and facade improvements to include removal and replace-
ment of exterior surfaces, new exterior running trim elements, and several new
vinyl-clad windows.
The activities proposed are categorically excluded under HUD regulations at 24 CFR
Part 58 from National Environmental PolicyAct (NEPA) requirements. An Environmental
Review Record (ERR) that documents the environmental determinations for this project
is on fileat the Townof Barnstable's Growth Management Department, 367 Main Street,

Floor, Hyannis, MA 02601 where the ERR can be examined and copied Monday
through Friday from 8:30am to 4:30pm.
PUBLIC COMMENTS
Any individual, community group, or agency may submit written comments on the ERR
to the Townof Barnstable, Growth Management Department, 367 Main Street, 3,a

Hyannis, MA 02601. All comments received by May 12, 2006 will be considered by the
Town of Barnstable prior to authorizing submission of a request for release of funds.
RELEASE OF FUNDS
The Town of Barnstable certifies to HUD that John C. Klimm in his capacity as Town
Manager consents to accept the jurisdiction of the Federal Courts if an action is brought
to enforce responsibilities in relation to the environmental review process and that these
responsibilities under NEPA have been satisfied HUD's approval of the certification
satisfies its responsibilities under NEPA and related laws and authorities and allows
the Town of Barnstable to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD/State will accept objections to its release of fund and the RE's certification
for a period of fifteen days following the anticipated submission date or its actual
receipt of the request (whichever is later) only if they are on one of the follow-
ing bases: (a) the certificationwas not executed by the Certifying Officer of the
name of RE, (b) the RE has omitted a step or failed to make a decision or finding
required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other
participants in the development process have committed funds, incurred costs
or undertaken activities not authorized by 24 CFR Part 58 before approval of a
release of funds by HUD/State. or (d) another Federal agency acting pursuant to
40 CFR Part 1504 has submitted a written finding that the project is unsatisfac-
tory from the standpoint of environmental quality. Objections must be prepared
and submitted in accordance with the required procedures (24 CFR Part 58, Sec.
58.76> and shall be addressed to HUD/State administration office at address of that

the objection period
