Rte. 28 • Centerville, MA Demolition wrangle spotlights divisions on Cape Cod Commission Hyannisport historic district property's fate to be decided By Edward F.Maroney emaroney@barnstablepatriot.com People pay alot of attention to the value of their homes on Cape Cod, but when is a house's value more than just the market price? Presented for your consid- eration: 17 Hawthorne Ave. in Hyannisport , an 1890s Queen Anne residence that finds itself in a twilight zone of competing interests. Its owners, Mannheim Realty Trust withan address on New YorkCity'sFifthAvenue,want to tear it down and build a similarly-sized home in the same style. Preservationists at town offices and the Cape Cod Commission say the value of the home lies also in its con- tribution to the Hyannisport Historic District. They fear such changes willdegrade the integrity of the district. Enter the Cape Cod Com- mission subcommittee charged with making a rec- ommendation on the request. Barnstable's representative to the land-use agency, Da- vid Ansel, was the lone vote against allowing demolition and new construction. De- molition was OK'd by the other three: Mark Harding of Mashpee, the commission's Native American represen- tative; Leo Cakounes, the rep from 'Harwich; and Bill Doherty, also of Harwich, the county commissioners chairman who serves as that group's representative. At last week'sX^ape Cod Commission meeting, a vote on the subcommittee's rec- ommendation was derailed when the cavalry rode into the fort in the forms of town planning and historic preser- vation staff, including Ruth Weil, director of the town's new growth management department. "The decision of the Com- mission's subcommittee to allow the demolition of 17 Hawthorne is inconsistent with the Town of Barnstable Local ComprehensivePan and the Town's goal of preserving significant historic structures, particularly those located with a National Register dis- trict," Weil wrote on Jan. 23 to the commission. Last Thursday, the com- mission remanded the matter to the subcommittee. That group met Monday and reaf- firmed its vote. "The (town's) lettersaidthat, intheir opinion,the request for demolition did not comply with the comprehensive plan of the Town of Barnstable," Doherty saidWednesday."The languageof thecomprehensive plan of Barnstable said 'shall' comply.However,the Cape Cod Commission language says it 'should' comply.This suggests a need for tightening of the language used to determine what guidance the Cape Cod Commission should take with regard to historic structures." Themore compellingreason for hisvote, Doherty said,was the commentary of Harding. The county commissioner said his colleague is a fed- erally certified restoration specialist, and that Harding believed that the building was not worth preserving to restore. "Theplans we've seen would attempt to have the (new) buildingsuccessfully integrat- ed into the neighborhood ," said Doherty. "I'm of the opinion that after a year or so of vegetation and getting the surrounding lawn back, you'd not know when the building was added. If they'd suggested a Bauhaus design, obviously that would not have any merit." On Thursday, Ansel said he based his vote on the rec- ommendation of the town's historic commission and the Cape Cod Commission's his- toric preservationist to reject the demolition request. "I can't sit here and tell you that I,asanuntrained layman, can look at a property and tell you there 's something about it," he said. "It's not Monticello, (but) I thought it was rather presumptuous for someonenot trainedto substi- tute my view for theirs." Ansel said the subcommit- tee and the full commission have to defer to the town and its local comprehensive plan. He plans to make that point at the commission's Thurs- day meeting, which begins at 3 p.m. in the basement of 1st Barnstable District Court House in Barnstable Village. "Frankly, " Ansel said , "I don't think this issue is over." Complaint against judge withdrawn The complaint filed against Superior Court Justice Richard F. Connon was withdrawn last Thursday. John Julius, lead plaintiff in the 10- taxpayer suit against the Barnstable's acquisition of the Barnstable Water Co., said that after consultation with his attorney, he decided to withdraw his complaint. Julius believed that, before hearing the case, Connon should have disclosed that hiswifeworkedfor the town'sschool department. Connon allowed Barnstable 's motion for summary judgment and dismissed the casein December.A notice to appeal has been filed. Julius's attorney in the case, Paul Re- vere II, told the Patriot last week that he was unaware of the complaint and believed it to be wrong. Revere added that he was considering resigning as counsel in the case as a result. DS II~ dstill@barnstablepatriot.com Expect property tax bills in about a month Thetowncouncil'sadoption of residential and commercial exemptions in November delayed what was planned to be a Dec. 31issue date for the second set of FY'06 property tax bills.The town'sassessing division needed additional time to pin down residency and business qualifications. Director of Finance Mark Milnesaidthat the final checks on the information and tax billing are being made, and bills should be out in about a month. Regardless of when the bills are issued,they willnot be due until May 1, Milne said. The new fiscal 2006 real estate assessments are avail- able in the AssessingDivision Office at Town Hall, Hyannis, and ineach villagelibrary.The new assessed values are ex- pected to go on-line shortly at www.town.barnstable.ma.us. Motor vehicle excise bills out next week Barnstable will issue the first motor vehicle excise tax bills of 2006 Feb. 6. Payment is due on March 8. The tax collector 's of- fice reminds taxpayers that online payments may be made by using the Town of Barnstable Web site, www. town.barnstable.ma, during the 30 days the excise bill is current. Abatement requests should be directed to the Assessing Division at 508-862-4022.
