Jan.20 against Superior Court
Judge Richard F Connon for
not disclosing that his wife is
an employee of the Barnstable
Public Schools. Julius be-
lievesthat because thejudge's
spouse is employed by the
town,whichisthe defendant in
the water company case, that
information should have been
disclosed.
Connon allowed the town's
motion to have the case sum-
marilydismissedlast month.A
notice of appeal for that case
was filed this week.
"As the lead plaintiff, if I
had known this, I would have
requested another judge!"
Juliuswrote in the complaint,
according to a copy provided
to the Patriot.
"I strongly feel that wenever
had our day in court," Julius
said in an interview Wednes-
day.
In an interview Wednesday
afternoon, Julius's attorney,
Paul Revere III, said that he
was "unaware" of the com-
plaint.
"I think it's wrong, and may
be resigningas counsel on the
basis of it being filed," Revere
said.
Complaints against judges
are kept confidential under
Massachusetts General Law
211C,whichisnotedinthefinal
paragraph of the complaint
signed by Julius.
"Iunderstand thatthiscom-
plaint and any other commu-
nication to or from the Com-
mission on Judicial Conduct
remain confidential..., " the
complaint form reads.
Thecommissionneithercon-
firms nor denies the existence
of complaints.
According to the Code of
Judicial Conduct, judges are
required to disqualify them-
selves from cases where "the
judge knows, or reasonably
should know, that the judge's
spouse orchildwhereverresid-
ing,oranyothermemberofthe
judge's family residing in the
judge'shousehold,has an eco-
nomic interest* m the subject
matter in controversy or in a
partytothe proceeding,which
interest could be substantially
affected by the outcome ofthe
proceeding."
Inadiscussionofthissection
available on the commission's
Web site, the following com-
mentarywas offered:
"If the judge believes there
is no real basis for disqualifi-
cation, ajudge may,but isnot
required to, disclose on the
record information that the
judge believes the parties or
their lawyers might consider
relevant to the question of
disqualification."
Attempts to reach Connon
through the Barnstable Clerk
of Courts office were unsuc-
cessful.

Bridges due for attention
The long debate over when and how
the matter of replacing the Bourne and
Sagamore bridges over the Cape Cod
Canal will get some official attention
from the Cape Cod Commission.
As part of the proposed revised scope
of work for the RegionalTransportation
Plan,emergency planningandlong-term
replacement issues will be studied. This
comes from arequest by the Cape'sMet-
ropolitan Planning Organization.
The work is expected to cost $37,500.
